Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Doglio mobile application (the "App") operated by Doglio ("we," "our," or "us"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years of age (or 16 in the European Economic Area), have read and understood these Terms, and agree to be bound by them. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own or control, solely for your personal, non-commercial purposes and in accordance with these Terms.

You may not:

• Copy, modify, or create derivative works of the App.
• Reverse engineer, decompile, or disassemble the App.
• Rent, lease, sell, sublicense, or transfer the App or your rights to use it.
• Remove any copyright, trademark, or other proprietary notices from the App.
• Use the App for any commercial purpose without our prior written consent.

3. User Accounts

Some features of the App may require you to create an account. You agree to:

• Provide accurate and complete information when creating your account.
• Keep your account credentials confidential and not share them with others.
• Notify us immediately of any unauthorized use of your account.
• Be responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and In-App Purchases

The App may offer free and premium features. Premium features may require a paid subscription or one-time purchase processed through Apple's App Store.

• Billing — subscriptions are billed in advance on a recurring basis (monthly or annual) through your Apple ID account.
• Auto-renewal — subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Cancellation — you may cancel a subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
• Refunds — all purchases are subject to Apple's refund policy. We do not issue refunds directly.
• Price changes — we may change subscription prices at any time. We will give you reasonable notice before any price change takes effect.

5. User Content

You may provide information such as your dog's name, photos, and training notes ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant us a limited license to use, store, and process it solely to provide and improve the App's services for you.

You agree not to submit User Content that is unlawful, offensive, harmful, or that infringes the rights of others.

6. Doglio AI Assistant

The App includes an AI-powered assistant ("Doglio AI") that provides general dog care and training guidance. You acknowledge that:

• Doglio AI provides general informational guidance only — it is not a substitute for professional veterinary or animal behavioral advice.
• AI responses may not always be accurate, complete, or applicable to your specific situation.
• For medical concerns about your dog, always consult a licensed veterinarian.
• We are not liable for any outcomes resulting from reliance on Doglio AI responses.

7. Prohibited Conduct

You agree not to use the App to:

• Violate any applicable law or regulation.
• Harm, threaten, or harass any person or animal.
• Attempt to gain unauthorized access to any part of the App or its systems.
• Transmit viruses, malware, or any other harmful code.
• Scrape, crawl, or extract data from the App without our written permission.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

8. Intellectual Property

The App and all of its content, features, and functionality — including but not limited to text, graphics, logos, icons, images, audio clips, and software — are owned by Doglio or its licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We make no warranty that the training methods or care guidance provided through the App will produce any particular result for your dog. All dogs are different and individual results may vary.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DOGLIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, OR (B) $10 USD.

11. Indemnification

You agree to indemnify and hold harmless Doglio and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your User Content, or your violation of these Terms.

12. Third-Party Links and Services

The App may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of those third parties. Accessing third-party services is at your own risk.

13. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we decide to discontinue the App. Upon termination, your right to use the App will immediately cease. Sections 8–15 of these Terms will survive termination.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction, as required by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, by sending a notification through the App. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
